I guess they might well have even factored in that if a tribunal finds against them and they get fined, the fine they will get is at most £X and its less than they stand to lose by either spinning it off at a loss or subsidising it as a ongoing business.

I assume 'viable' has something to do with dividends or profits: 'shareholders told us that dividends less than seven figures are not viable'. Surely it would take an extraordinary level of mismanagement for a ferry company based on an island to be in danger of going under. DP World will have already worked out that the benefits outweigh the risks/costs, financial shenanigans will make costs trivial. Cancelling all their contracts and telling them to fuck off is the only real punishment, and we know that's not happening.

I know this isn't all about Brexit, but in older times the government would cry 'EU red tape' when asked to intervene, now they'll just shrug.
