There's speculation they'll fire all staff and replace them with foriegn workers working through agents.

Website: If you do not consult employees in a redundancy situation, any redundancies you make will almost certainly be unfair and you could be taken to an employment tribunal. And after that you’ve got the fact that the job still exists which makes a good case. |

The government should take harsh, swift action against DP World, but of course they won't. Tories would love this kind of shit to be the norm - 'cutting red tape' or some bollocks. I've only just seen this, it really is the real life version of the Simpsons scene where Kirk gets fired from the Cracker factory. Fucking disgusting but I get the strongest feeling they'll get away with it, there'll be talk of government pressure but nothing will materialize and in terms of PR it will be terrible for a while but customers will carry on as normal. However we'll see what will happen when you consider the new staff are being given a week's training and their employment terms and conditions are absolute dogshit.

I get involved in redundancies from an insider threat perspective and by the time boots on the ground know about it, its been through every branch of governance in the company twice over. Management will have been preparing for this since christmas.

To sack people with immediate effect and then immediately replace them with a cheaper alternative is just fundamentally incompatible with what I understand about employment law. IANAL but I do employ people, and have needed to brush up on it intermittently when dealing with some tricky people in the past. If I knew you could do this I would have done it ten times over by now. (Jokes, I wouldn't. Please don't hate me).
Redundancy requires a process of consultation and they can't claim redundancy in any case as they just drafted in a whole load of replacements. Changes in pay or condition need consultation.
The only way I can see that this is legal is if the staff they got rid of were all contractors, and not employed staff.

Yeah, does seem like it's the consultation where they done fucked up. The tribunals should have a field day. My guess is that they're banking on offering a bit more to go quietly. They may have misjudged that though, not least as there will be loads of lawyers who will take them on pro bono.
Nothing will happen from Govt side though, apart from hand wringing.

I think this is a deliberate gamble. They dont *have* to give a consultation period but the fact that they havent opens them up to 800 unfair dismissal tribunals which they are betting most people wont be arsed with.
